Abstract

Research title: Dispute (reality, types, causes, rulings of denouncing the opponent) as a radical study

Researcher: Dr. Faisal Dawood Sulaiman Almuallim

Research problem and goals: the research aims to answer following questions:

Is every dispute legitimate in terms of Shares? Or should the opponent be always denounced?

Is it obligatory to denounce the opponent in all matters? Or always to avoid denunciation since dispute nature should be accepted as a universal law?

How to differentiate between legitimate and illegitimate disputes?

Research plan: it constitutes of an introduction and background. There are two items in which I’ve explained that the dispute is originally a universal law as well as that the truth is a single not multiple.

This is followed by two researched points.

In the first researched point, I’ve presented three items: 1. The dispute reality, 2. The dispute types, and 3. The dispute causes.

In the second researched point, I’ve presented the ruling of denunciation on matters concerning which scholars differed. There are three items:

In the first item, I’ve demonstrated the Shareaa objective of denunciation

In the second item, I’ve presented the Shareaa regulations concerning matters in which denunciation is illegitimate.

In the third item, I’ve presented the Shareaa regulations concerning matters in which denunciation is legitimate.

In conclusion, I’ve stated the key results and recommendations

Research methodology: I’ve followed the descriptive Indicative methodology which is based on presenting and describing the matter before stating the most correct opinion.

Research results: thanks to Allah who help to get several results. Main results are the following:

Warning against ignorance of the legitimate dispute regulations and against ignorance of matters concerning legitimate denunciation. such ignorance might cause a disorder, fanaticism, or unjustified negligent.

Indeed, most of Islamic scholars disputes are from the legitimate type that shouldn’t have denunciation.

Illegality of denunciation on matters that are subject to ijtihaad does not prevent revealing the truth of the correct opinion, since the truth is one.

Promotion of virtue and prevention of vice is an Islamic necessity for the nation salvation and for achieving moderation. It is the base to establish Sharia and to save the religion. Therefore, truth is clarified, justice spreads and injustice is removed.
