Abstract

This research (Jurisprudential Rulings Derived from the Hadiths of Rulings: A Fundamental Study (Chapter on the Prohibition of Stabbing Animals, Castrating them, Provoking them, and Marking them on the Face) from the Book Al-Muntaqa min Al-Akhbar by Majd Al-Din Abi Al-Barakat Abdul-Salam bin Taymiyyah Al-Harrani (d. 652 AH)), aims to derive jurisprudential rulings and to study them comprehensively. The deductive approach was adopted to explain the peculiar jurisprudential terminology, stating the general meaning of the hadiths, and the relationship of the hadiths with other texts, as well as elucidating the fundamental connotations of hadiths' vocabularies, explaining jurisprudential issues, trailing the sayings of the jurists of the four schools of thought by presenting their opinions and evidence in addition to discussing them, deducing jurisprudential and fundamental rules from the hadiths, and extracting contemporary issues that can be included under the issues of the hadiths. The research reached different results, the most prominent of which:

  • Imam Majd al-Din Ibn Taymiyyah had a prominent scientific position in the pages of history, as he was one of the scholars of absolute ijtihad, and he classified many valuable books in jurisprudence, interpretation, fundamentals, readings, and Hadith.
  • The book Muntaqa al-Ahkam al-Shari'ah min Kalam Khair al-Bariyah is considered one of the most important scientific works of Imam Majd al-Din Ibn Taymiyyah, as it is one of the most comprehensive and extensive books that dealt with the Hadiths of legal rulings.
  • Studying the hadiths of the Prophet according to the approach I followed in this research has a great impact on the researcher in expanding his legal perceptions and forming his jurisprudential faculty through linking, extracting, analyzing, and deducing.
  • Prohibiting the stabbing of animals and provoking them, permitting the marking of animals on all parts of their bodies except the face according to the majority of jurists, prohibiting striking animals on their faces and permitting castration of animals according to the majority of jurists if it is intended to benefit, permitting scientific experiments on animals provided that the animal is not exposed to harm, and prohibiting bullfighting.
