The Legal Protection of the Elderly An Analytical Legal Study

Abstract

This research aims to clarify the legal and statutory texts related to the protection of the elderly, and to clarify the most prominent preventive and curative methods in protecting them, and the role of government agencies specialized in caring for and protecting them. The researcher followed the descriptive analytical approach in studying the subject of the research by studying the Law of Rights and Care for the Elderly in the Kingdom of Saudi Arabia. The research consists of an introduction, three sections and a conclusion; the first section is about the definition of the research terms, which are five terms; the second section is on the protection of the elderly religiously and legally, and it has two sub- sections; and the third section is on the most important preventive and curative efforts to protect the elderly, and it has two sub- sections; and the conclusion included the most important findings of the research and recommendations. The most important results of the research are: that the Shari’ah is distinguished by its preventive approach in preserving the rights of the elderly, which aims to obstruct everything that leads to disrespect and harm to the elderly, and that the rights set by the Saudi regulator in the Law of Rights and Care for the Elderly and its Executive Regulations are in accordance with the provisions of Islamic law, and that the Public Prosecution is the body vested with the role of investigating violations committed against the elderly in Saudi Arabia. The researcher recommended more studies and holding seminars and conferences on the subject of caring for the elderly, and emphasizing on officially related authorities in preparing official and periodic statistics for violations committed against the elderly, intensifying the message of the mosque in this regard, and the need to invest in the media and social media platforms to spread awareness about it.
