TOPIC: The Effects of the Coronavirus Epidemic on Lease Contracts (A Jurisprudential Study)
OBJECTIVES:
- To make a documentation of the effects of the epidemic on lease contracts based on the jurisprudence of the ancients and contemporary scholars.
- To explain the effects of the Coronavirus on Lease Contracts.
- To discuss the effects of the Coronavirus on dropping part of the rental from the lessee, corresponding to the curfew days for the existing contracts.
METHODOLOGY: The deductive inductive approach was followed, by extrapolating scientific materials related to the topic from the original sources of books of jurisprudence in general and books of the Four Doctrine of Jurisprudence in particular with a review of what contemporaries wrote on this topic.
SIGNIFICANT RESULTS:
- To make a documentation of Coronavirus on pandemics, excuses, and urgent circumstances.
- The lease contracts that have been agreed upon, but the leased property has not been used, may be terminated.
- For the existing contracts that have due periodic installments, both of the lessee and the lessor shall be required to complete the contract term, and the rental payment right of the lessee shall be forfeited corresponding to the curfew days.
RECOMMENDATION: The researcher recommends studying the effects of epidemics on Islamic worship and transactions.
