Abstract

This research aims to display the legal mandated provisions for actions resulting from financial relations in renting and loans. It does not address the legal man-made provisions for the various aspects of rent and loan in terms of validity or nullity.

The research contains an introduction, two chapters, and a conclusion. The first chapter is about mandated provisions of the financial relations in lease. The second is on mandated provisions of the financial relations in loan.

The researcher reached the following results:

  1. Gentleness to laborers is proof of the leniency of Islam, and helping them in their work is stimulated for. Moreover, assigning them to do what they cannot bear is forbidden by Shari'a.
  2. That giving the laborer his//her wages as soon as he//she finishes his//her work is enthused, and that procrastination or withholding his rights is considered prejudicial.
  3. It is forbidden for a Muslim to help with what is forbidden, among this is: renting out something forbidden.
  4. Protecting the leased property from what may damage or harm it is an imperative duty of the Muslim.
