The Impact of Not Specifying the Dowry in Light of the Rulings Related to His Saying: "There is no Blame upon you if you Divorce Women you have Not Touched Nor Specified for them an Obligation. But Give them [a Gift of] Compensation, the Wealthy According to his Capability and the Poor According to his Capability, a Provision According to What is Acceptable, a Duty upon the Doers of Good." [Al-Baqarah: 236]

Abstract

Praise be to Allah and may the peace and blessings of Allah be upon Prophet Muhammad and all his Family and Companions;

Indeed, Allah, the Exalted, has legislated marriage and established rulings that preserve the two essential components of the marriage contract: the husband and the wife, along with their rights and statuses. Among what the legislator has prescribed for the wife is a gift of appreciation that safeguards her status right from the beginning of the contract, which is the "dowry." The dowry has specific rulings in various circumstances.

In this research, which I have titled: (The Impact of Not Specifying the Dowry in Light of the Rulings Related to His Saying: "There is no blame upon you if you divorce women" [Al-Baqarah: 236], I have explored these rulings due to the importance of studying the provisions of the dowry related to the verse, and other great rulings in the legislation of the dowry. The ruling on marriage without mentioning or specifying the dowry was examined, and it was concluded that it is permissible according to Islamic law. Also, the differing opinions of scholars regarding the dowry for a woman who has been divorced after the private meeting but before consummation was looked into, as well as the variations among scholars in this case on whether the dowry is obligatory or if compensation should be provided instead. Finally, the research was concluded with an evaluation of the compensation for the divorced woman and included a conclusion highlighting the main findings and recommendations, the most important of which is that I recommend researchers to pay attention to the provisions of the dowry in Islam.
