Abstract

In this research entitled: “Islamic Sharia's protection of the family from divorce, a fundamental study”, there is an attempt to show how Sharia intentions can contribute to protecting the family from the factors of dissection such as divorce and the like, by discussing the importance of Sharia intentions in safeguarding the family, stating the Sharia intentions in legalizing divorce, and explaining the most prominent reasons that led to the increase of divorce cases in our society, as well as the influence of Sharia intentions in diminishing this problem. In this research, I followed the inductive-analytical approach to the texts concerning the family jurisprudence and the Sharia intentions it included, as well as searching for the causes leading to divorce through studies devoted to monitoring this phenomenon. Among the most important research results: explaining the role of Sharia intentions in protecting the entity of the Muslim family and protecting it from disintegration and loss, and that the Sharia intent of the legality of divorce was derived from taking into account the interests of both spouses and based on protecting the constancy of the marital relationship and its continuity as much as possible. In addition, the research stresses the importance of rehabilitation courses for those who are about to marry in reducing cases of divorce.
