The current research has begun to clarify the contents of this glorious Sharia, and to study its teachings, with the aim of deriving a practical approach in application, effective in impact, ridding the world of newly created environmental crimes, and negating their impact, which has become a concern that haunts humanity in all parts of the globe.
In general, the research aims to reveal the approach of Islamic law in reducing environmental crimes, using the descriptive analytical method.
The research included the approach of Islamic Sharia in limiting environmental crimes, establishing the rule (no harm, no harm), criminalizing environmental corruption, controlling the rule (necessities permitting prohibitions), and legislating the penalty for environmental corruption.
The research resulted in important results, the most important of which are:
- 1. Preserving the environment and protecting it from crime is one of the purposes of Islamic Sharia, in fact, it is one of the most important overall goals that the Sharia has indicated to preserve and consider.
- 2. Islamic Sharia is valid for every time and place, and it contains the generalities of texts, sources and rules of legislation that help in establishing an integrated law to protect the environment, and to confront all emerging environmental crimes.
- 3. The procedures adopted by Islamic Sharia to reduce environmental crimes represent contemporary policies that Arab and international conferences have advocated and recommended in confronting environmental crime, especially after the failure of legislation, and punitive policies alone in confronting crime, and their inability to deter.
