Research problem:
The research problem can be summarized as follows:
- 1. The frequent occurrence of apostasy، especially in this age، due to the distance from religion and the devotion to the world and its submission to the hereafter، the frequent contact with infidels and their influence with them، with ignorance of God’s religion، and the weak adherence to the correct belief of many Muslims، which caused them to fall due to their ignorance and weak adherence Their religion in apostasy، God forbid.
2.The Muslims need to know the rulings on apostasy in general، and on the apostasy of one or both spouses in particular - which is the subject of our research - and which is entitled "the apostasy of one of the spouses and its effect on marriage"، and to know the sayings of the jurists in this and the most correct of their sayings، and the consequent of this: Killing the apostate، not praying on him، dissolving his money، abrogating his marriage، and taking into account - during the warning about the apostasy of one or both spouses - the symptoms of eligibility when judging people، such as ignorance، interpretation، error، coercion، and the like.
Their eyes without paying attention to the meeting of conditions and the absence of Steeplechase.
- 3. Linking this issue to the reality of people، their lives and their sayings، because it touches a reality in which they live، interact with and are affected by it.
Conclusion: It includes the most important findings and recommendations.
The most important results:
1.The apostasy is great and dangerous، and the apostate is greater than the original infidel، so the apostate is the rule of killing، because he does not inherit or marry، and his sacrifice is not eaten، unlike the original infidel.
- That the apostasy had to annul the marriage at once، for God Almighty said: “Do not hold the hand of God، ” and to God Almighty: {Do not return them to those who disbelieve، there is only for him.
- If the apostate is the wife، then she has nothing.
- If the apostasy is after entering، the wife has the full dowry، whether the apostate is the husband or the wife.
