Abstract

Islamic law originated for the interests of worshipers in the present and the future, in this world and the hereafter. This is evident in the establishment of confines and defamings,  which serve as a protective shield to preserve religion,  ensure personal safety,  maintain wealth,  safeguard honor,  and protect the intellect. As a result,  religion is privileged,  honor is preserved,  souls are secure,  wealth is safeguarded,  and the intellect enjoys the blessing of awareness. This leads to societal well-being through security and stability.

Hence,  the idea of writing this topic emerged,  where the researcher defines confines and defamings,  highlighting the differences between them and similar concepts such as retaliation or crime. The research discusses the five necessities and their impact on establishing confines and defamings,  outlining the categories of confines in Islamic law and their degrees of punishment. It also elucidates the rulings,  interests,  and secrets behind the legitimacy of confines and defamings,  presenting the teachings that Islam considers before,  during,  and after instituting confines to showcase the virtues of Islamic law. Additionally,  it addresses some suspicions from spiteful critics regarding executing confines and outlines the optimal application in contemporary judicial issues and developments.
