The Rule of: "No harm, no foul" and its Contemporary Applications in Means of Communication "Mobile Phone as an Model"

Subject of the study: “The rule: No harm, no foul, and its contemporary applications in means of communication: “mobile phone as model.” It aims to explain this jurisprudential rule in deriving rulings in the field of modern communications, and for the Muslim to be aware of these rulings, so that he/she is attentive and insightful.This study is based on the inductive and analytical approach, as the researcher traces the details of the subject in its various contexts and resources, then lists and divides them, placing them under its overall basis, while explaining the legal rulings on it and mentioning evidence with each ruling. Among the most important results: the richness of Islamic jurisprudence with all that it embraces of rules, regulations and jurisprudential theories, and that all new transactions and calamities, God Almighty has a ruling over them, and He helps His sincere servants to reach them and be aware of them. Accordingly, it is recommended: the necessity of paying attention and researching modern calamities and developments - especially what is related to modern technology - in accordance with the rules and evidence of jurisprudence, and explaining what Islamic jurisprudence includes in terms of legal objectives and educational rulings. God Almighty, I ask him for success and guidance.
