The Role of the State in Overseeing the Quality of Goods and Products in Islamic Jurisprudence
Keywords:
state, quality, markets, products, commodities, supervision, HisbaAbstract
Islamic law has given particular attention to ensuring the quality and validity of goods and products available to consumers in markets, especially with regard to food, drink, and clothing. The role of Islamic law does not merely confine to theoretical considerations or sheer discourse, but extends towards practical application and ongoing follow-up to ensure this. This is implemented by a series of procedural legislations that guarantee quality and safety in these goods and products. This study aims to shed light on one of the aspects of the state's role in monitoring markets to ensure they are free from defective and counterfeit products. It explains the means by which the state exercises control over markets, primarily through the Hisba (market regulation) system, and then outlines the purposes and objectives of this market oversight, adopting a descriptive approach. The study concluded that the tasks of Hisba are currently performed by representatives of the Capital Secretariat, municipalities, market inspectors, health inspectors, and others. Among the duties of the Hisba is the control of product quality and inferior products, the supervision over correct weights and measures, and similar tasks.
