The Regulation of Hajj Worship in Islamic Jurisprudence and Administrative Oversight of its Performance

Abstract

This research addresses the regulation of Hajj Worship in Islam and the administrative role of the Ministry of Hajj and Umrah in supervising it. It aims at locating the Ministry’s oversight resources,  forms,  in addition to displaying its methods of supervision, prominent violations and the corresponding penalties,  according to the applicable laws of Hajj and Umrah in the Kingdom of Saudi Arabia. The researcher employed the inductive approach by collection and pursuit of whatever in connection to oversight at the Ministry of Hajj and Umrah. Moreover,  the analytical approach was employed for analyzing and interpreting the laws on regulating Hajj and Umrah,  as well as for deducing the resources,  forms and methods of oversight at the Ministry of Hajj and Umrah.

The study concluded that the Ministry of Hajj and Umrah derives its legitimacy and duties from the directives issued by the ruler. The administrative supervision at the Ministry of Hajj and Umrah varies according to the laws enacted for regulating the work of the Ministry of Hajj and Umrah. For achieving the goals of oversight process at the Ministry of Hajj and Umrah,  the Ministry plays its supervising role through a number of control methods,  such as administrative inspection,  seizure report,  committee of penalties consideration and complaints portal.

The study recommends that the Ministry of Hajj and Umrah should publish the penalties on its website for minimizing the penalties and promoting competition between the companies and establishments of Hajj and Umrah service providers. Moreover,  researchers are recommended to conduct further studies on the supervision by the Ministry of Hajj and Umrah,  such as supervision applications at the Ministry of Hajj and Umrah,  hindrances of supervision at the Ministry of Hajj and Umrah,  etc.
