Analogy by Resemblance in Islamic Jurisprudence - An Analytical and Foundational Study

Analogy (Qiyas) constitutes the fourth source of Islamic legislation and remains one of the most intricate and debated subjects within the principles of jurisprudence (Usul al-Fiqh). This study aims to elucidate the "Analogy of Resemblance" (Qiyas al-Shabah), a concept characterized by a subsidiary case (Far’) oscillating between two or more original precedents (Asl) due to an underlying resemblance, albeit without a clearly disciplined or manifest effective cause (’Illah). To achieve this, the research employs an inductive methodology by tracing the classical texts of legal theorists and jurists, an analytical approach to scrutinize definitions and their critiques, and a comparative framework to weigh between the jurisprudential schools of thought.
The research has yielded several significant findings, most notably that Qiyas al-Shabah occupies an intermediate position; it transcends the "Coincidental Description" (Al-Wasf al-Tardi) which lacks substantive legal meaning, yet it does not attain the certainty of "Analogy of Cause" (Qiyas al-’Illah) regarding its direct suitability to the ruling. Furthermore, the essence of this analogy lies in being a description that merely suggests suitability (Muwhim al-Munasabah) without definitive verification, or alternatively, a description suitable to the cause of the ruling rather than the ruling itself. The study also concludes that defining Shabah as the "preponderance of similarities"—where a branch fluctuates between two origins—lacks precision, as it fails to encompass all manifestations of similarity and often overlaps the boundaries of Qiyas al-’Illah.
The study concludes with a series of recommendations, emphasizing the necessity of refining jurisprudential terminology related to "Imagined Interest" (Al-Maslahah al-Mutawahhamah) to strictly delineate the boundaries of similarity-based analogy and prevent its conflation with other legal constructs. Moreover, the study calls for the active utilization of Qiyas al-Shabah in deducing rulings for contemporary unprecedented issues (Nawazil) whose characteristics are suspended between multiple Sharia foundations. This application must, however, strictly adhere to the established criteria that distinguish it from mere coincidental correlation, ensuring the integrity of the legal deduction process.
