The Social Solidarity Funds of the Chechen “Tshinkhoy” Tribe and its Compliance with Islamic Sharia

Abstract

This study aimed to shed light on the social solidarity fund of the Chechen “Tshinkhoy” tribe, considering it a traditional model of community cooperation based on the principles of Islamic solidarity (takaful). The research explored the jurisprudential classification of this fund, examining its alignment with Islamic legal foundations. It also addressed a number of legal and organizational inconsistencies found within the fund’s governing document, highlighting areas of deficiency—particularly the lack of clarity regarding the nature of participation (mandatory or voluntary), and the absence of essential regulatory provisions that ensure fairness in commitment and distribution. The study relied on the descriptive approach in portraying the fund and analyzing its components, and the analytical approach in discussing the related legal and organizational texts, in addition to the inductive approach in tracking the opinions of jurists and their positions from such funds. The study concluded by proposing a set of jurisprudential and administrative treatments aimed at strengthening the fund’s legitimacy and operational efficiency, by determining the jurisdictions of action and its controls, as well as clarifying the contracting relation with the participants. It recommended spreading the culture of Sharia solidarity through awareness programmes inside the tribe.
