Terrorism Through Aggression on Lives and Properties: its Treatment and Prevention, a Quranic and Jurisprudential Study

Abstract

This study aims to revive scholarly discourse on terrorism and urge the state to protect society from its causes through effective deterrence. As extremist ideologies may reemerge in every era, the study emphasizes the necessity of proactive and punitive measures. It concludes that the Qur’an outlines both preventive and corrective approaches to counter terrorism, safeguarding lives and property regardless of religious affiliation.

The research supports these facts through the legal opinions of Hanafi jurists, highlighting their relevance to contemporary challenges.

It further argues that effective prevention requires the state’s active role in educational and moral reform, strengthening the relationship between rulers and citizens, implementing Islamic law, and engaging in dialogue with those holding deviant ideologies. Moreover, the study advocates for the enforcement of strict discretionary punishments to curb the spread of extremist actions and thoughts.
