Jurisprudential Variances in the Book Al-'Inya'ah 'ala Al-Hidayah of Al-Babarti

Abstract

This study aims to identify the jurisprudential variances in the book Al-'Inya'ah 'ala Al-Hidayah of Al-Babarti, clarifying the areas of agreement and difference in issues that are similar in form but different in ruling, and explaining the origin of the construction of each issue.

The problem of the study can be clarified by answering the following questions:

What are the jurisprudential differences in the book Al-I'ya'ah 'ala Al-Hidayah of Al-Babarti?

What are the areas of agreement and disagreement on issues that are similar in appearance but different in ruling?

What is the basis of construction for each of these issues?

The study reached the following results:

Imam Al-Babarti's accuracy in distinguishing between issues that are similar in appearance and different in ruling; that each of the issues that agree in form has a different origin from the other issues; that there may be a common origin but the ruling differs; and that the similarity between two issues does not give them a single ruling, but rather each issue has its own ruling.

The researchers recommend studying the jurisprudential variances from approved books in the Hanafi school of thought, explaining the origin of the issues and the differences between them in ruling, and studying the remaining issues in the book Al-Inaya of Imam Al-Babarti.
