The Jurisprudential and Fundamental Rules Governing the Jurisprudential Mind in the Calamity of Epidemics – Corona as a Model

Abstract

The subject of this research revolves around the importance of fundamentalist and jurisprudential rules in deriving legal rulings for emerging issues in epidemics in general and Corona in particular. It addressed the terms of the study by analyzing the meaning of fundamentalist and jurisprudential rules, the meaning of calamities and epidemics, in addition to explaining the importance of these rules in controlling the jurisprudential mind, and their effective role in dealing with emerging issues as epidemics. Then, examples of the fundamentalist and jurisprudential rules were displayed besides their inferences in contemporary applications in Corona epidemic as a practical model. The research followed the analytical deductive approach in displaying the flexibility and keeping pace of Islamic Sharia with variables.
